These Terms & Conditions (“Terms”) govern the use of services provided by Volare Aerial Videography LLC, operating as Volare Video (“we,” “our,” or “us”). By hiring us for photography, videography, aerial/drone operations, or any related service, you (“Client”) agree to the following terms.

1. Payment Terms

1.1 Standard Payment

Unless otherwise agreed in writing, payment is due Net 30 from the date of project completion and delivery.

1.2 Deposits

For certain projects, we may require a 50% deposit before scheduling or beginning work. The remaining balance is due Net 30 after project completion.

1.3 Accepted Payment Methods

We accept:

  • ACH
  • Check
  • Zelle
  • PayPal
  • Credit card payments (3% processing fee applies)

2. Scheduling & Rescheduling

We do not require advance notice for cancellation or rescheduling. However, all projects are subject to weather and safety conditions (see Section 3). If a project must be rescheduled due to weather or airspace conditions, no cancellation or additional fees apply.

3. Weather, Airspace, and Safety

3.1 Weather Conditions

Drone operations are restricted by weather. We cannot fly during:

  • Rain
  • Strong winds
  • Unsafe visibility
  • Any FAA-prohibited conditions

The drone pilot has sole discretion to determine whether conditions are safe for flight.

3.2 FAA Compliance

All aerial operations must comply with FAA Part 107 regulations. This may include:

  • Airspace restrictions
  • Temporary flight restrictions
  • Prohibited proximity to people or vehicles
  • Daylight or night-flight rules

3.3 Project Delays

We are not responsible for delays caused by:

  • Weather
  • FAA regulations
  • Airspace authorization delays
  • Unsecured or unsafe flight environments

4. Ownership & Licensing of Media

4.1 Ownership

Volare Aerial Videography retains full copyright and ownership of all photos, videos, and media captured during any project unless explicitly transferred through a signed contract. Copyright transfer may incur additional fees.

4.2 Client License

Once all project payments are completed in full, the client receives a perpetual, royalty-free license to use the delivered media in any manner they choose, including commercial purposes.

No license is granted until payment is received.

4.3 Portfolio Rights

We retain the right to use any produced media in:

  • Our portfolio
  • Website
  • Social media
  • Marketing materials
  • Demonstrations and proposals

Unless a written confidentiality or NDA agreement is executed prior to the project.

5. File Delivery & Retention

We retain project files indefinitely for archival purposes.

However, delivery links (e.g., Google Drive) remain active for 3 months after project completion. Clients may request re-sending of files at any time.

6. Liability & Client Responsibilities

6.1 Safety and Property Access

Clients are responsible for ensuring that:

  • All necessary permissions for filming or photographing on private property are obtained.
  • The location is safe and accessible for ground and aerial operations.
  • No unsafe conditions or hazards exist that would endanger personnel or equipment.

6.2 Limitation of Liability

We are not liable for:

  • Delays due to weather, FAA restrictions, or unsafe conditions
  • Losses related to scheduling changes
  • Incidental, consequential, or indirect damages
  • Unauthorized use of deliverables by third parties

7. Refunds & Quality Standards

Refunds or partial refunds may be provided only at our discretion if the final deliverables fail to meet our own professional quality standards.

Examples include:

  • Missing key features specifically requested beforehand
  • Technical issues that degrade image quality
  • Obvious errors affecting deliverability

Refunds are not guaranteed and are evaluated case-by-case.

8. Travel Fees

Travel fees may apply to locations more than 45 minutes away (each direction) from our base in Austin, Texas. Travel fees will be communicated prior to booking whenever possible.

9. Use of the Website

By using our website (volare.video), clients agree not to:

  • Misuse forms or submission features
  • Attempt to access restricted areas
  • Copy or distribute copyrighted content without permission

10. Changes to These Terms

We may update these Terms from time to time. The updated version will include the “Last Updated” date at the top of this page. Continued use of our services constitutes acceptance of any changes.
